The Democratic Republic of the Congo (DRC) has gained prominence due to the presence of #CriticalMinerals<\/a> in its soil. The DRC is the top #cobalt<\/a> producer, with 70% of the world’s output, and is also the second-largest #copper<\/a> producer, accounting for 15% of global output. In addition, the DRC produces nearly half of the world’s coltan.<\/p>\n\n\n\n

Copper and cobalt tend to occur together and are concentrated in the Lualaba and Haut-Katanga regions, in the so-called Copperbelt. Gold is found in the eastern regions. #Coltan<\/a> occurs mostly in the eastern provinces of North and South Kivu. Recently, #lithium<\/a> deposits, occurring as lithium-caesium-tantalum pegmatites, were discovered in the Manono region in the Tanganyika province, along the so-called Kibara Belt.<\/p>\n\n\n\n

In order to ensure greater benefits locally, the DRC Government has been amending the mining code to increase local content and promote local value addition. Thus, all mining companies are required to allocate 5% of their shareholding to Congolese employees. Actually, this clause was in the Mining Code since 2018, but is now being strictly enforced.<\/p>\n\n\n\n

Any mining project must have at least 10% local participation, including the 5% to employees. In addition, the Government will hold a free carry non-dilutable stake of 10% upon first delivery of the mining permits. Then, the Government will require an additional 5% upon each renewal. The Government shareholding is usually via the state-owned enterprise Gecamines. In addition, subcontractors employed on mining projects must be controlled by a Congolese partner holding at least 51% in the company. <\/p>\n\n\n

Export of ores is also subject to a quota system since 16 October 2025. Thus, for cobalt, the annual cap is set at 96,000 tonnes for 2026 and 2027. As per the 2025 regulations, it is now illegal to mix cobalt-copper ores from artisanal and industrial mining. The state-owned Enterprise G\u00e9n\u00e9rale du Cobalt<\/em> now holds the monopoly on buying and aggregating output from artisanal miners for better control and traceability.<\/p>\n\n\n\n

Minerals are taxed a royalty fee upon export. Critical Minerals such as cobalt, coltan and germanium are subject to a 10% royalty rate. Base metals such as copper and tin carry a 3.5% royalty.<\/p>\n\n\n\n

In addition, a windfall tax of 50% applies to profits earned when mineral prices rise by 25% above the level set in its feasibility studies. As part of the ESG commitments, mining companies must allocate at least 0.3% of their turnover to community development projects in the neighborhood of the mine or complex. <\/p>\n\n\n
